ESAF Foundation (hereinafter referred to as "ESAF"/ "Website"/ "We"/ "Us") is registered under Section 12AA and Section 80G of the Income Tax Act, 1961. By making a donation to ESAF, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set out in this Refund and Cancellation Policy, as amended by ESAF from time to time at its sole discretion.
Donations to ESAF may be made through any of the following methods:
Online through the ESAF website (https://www.esaffoundation.org/) using credit card, debit card, net banking, UPI, Google Pay, PhonePe, Paytm, or any other payment method made available on the payment gateway; or By cheque or demand draft drawn in favour of ESAF. At the time of making an online donation, you will be required to provide certain personal information, including:
Full Name
Postal Address
Email Address
Mobile Number
Such information shall be collected and processed in accordance with ESAF's Privacy & Cookies Policy.
ESAF reserves the right, at its sole discretion, to reject any proposed donation without assigning any reason. A donation may also be declined if its acceptance would, in ESAF's opinion, violate applicable law or these Terms and Conditions.
Where ESAF subsequently determines that a donation has been received in contravention of applicable law or these Terms and Conditions, ESAF reserves the right to refund such donation or otherwise deal with the amount in a manner it considers appropriate.
Upon successful receipt of a donation, ESAF shall issue an acknowledgement to the donor. Where applicable, ESAF may also issue a tax exemption certificate. The decision of ESAF regarding the issuance of such certificate shall be final and binding.
Donors are responsible for ensuring that their donations comply with all applicable laws and these Terms and Conditions. ESAF shall not be responsible for verifying such compliance.
ESAF does not provide legal, tax, or financial advice. Donors are advised to consult their own professional advisors regarding the tax implications of their donations.
ESAF values the trust and generosity of its donors and is committed to handling refund requests fairly and transparently.
Each request for refund shall be examined on its individual merits. However, ESAF is under no obligation to refund any donation and reserves the right to accept or reject any refund request at its sole discretion.
Without limiting the foregoing, ESAF may decline any refund request where a tax exemption certificate has already been issued or where refunding the donation would otherwise be inconsistent with applicable law or its internal policies.
Donations, once processed, cannot be cancelled. Refunds shall be considered only in accordance with this Policy.
A donor seeking a refund shall comply with the following procedure:
A written request must be submitted by email to "donations@esaffoundation.org" within five (5) calendar days from the date on which the donation was made ("Refund Request Period").
The refund request shall apply to donations made:
Online through the ESAF website using any available electronic payment method; or By cheque or demand draft received by ESAF or its authorised representative.
Refund requests received after the expiry of the Refund Request Period shall not be entertained.
Partial refunds shall not be permitted.
The written refund request must include:
Reason for requesting the refund;
Date of donation or cheque/demand draft;
Amount donated;
Cheque or Demand Draft Number (where applicable);
First four (4) and last four (4) digits of the credit or debit card used (where applicable);
Donation ID (for online donations);
Permanent Account Number (PAN);
Payment receipt, transaction ID, or reference number.
ESAF may request additional information or supporting documents for verification. The donor shall promptly provide such information.
Upon receipt of all required information and documents, ESAF shall review the request and communicate its decision.
The decision of ESAF to approve or reject a refund request shall be final and binding.
If the refund request is approved, ESAF shall initiate the refund process as soon as reasonably practicable. However, ESAF does not guarantee any specific timeline for completion of the refund.
Where it is not feasible to refund the donation through the original mode of payment, ESAF may process the refund through any other lawful and reasonable method. The donor shall provide such information, including bank account details, as may be required to facilitate the refund. Failure to provide the requested information may result in rejection of the refund request.
Nothing contained in this Policy shall limit ESAF's right to refund or otherwise deal with any donation which, in its opinion, has been received in breach of applicable law or these Terms and Conditions.
ESAF reserves the right to amend, modify, or withdraw this Refund and Cancellation Policy at any time without prior notice. Any such amendment shall become effective upon publication on the ESAF website.
